WATERSEER Warranty

This Limited Warranty applies to the initial purchasers of the Product or spare parts and is not transferable to any other party and covers in home and commercial use of the Product.

WaterSeer™ warrants against any replacement WaterSeer™ spare parts received from WaterSeer™ or any of its authorized dealers for a period of ninety (90) days after the date of shipment.

A customer making a warranty claim is responsible to return the defective Product or component to WaterSeer™ ’s factory or its nominated service center, prepaying all postage or other shipping charges. The Product or component must be returned to your nearest WaterSeer™ office or nominated service center.

The customer must notify WaterSeer™ of his/her intent to return the Product or component and receive a confirmed acknowledgement from WaterSeer™ before the Product is returned.

A claimant must ensure that the defective Product or component are properly packed to protect it from damage during shipping. WaterSeer™ will not be responsible for any damage that occurs to the Product or component during shipment.

WaterSeer™, will review, repair, or replace the Product or component at WaterSeer™ ’s discretion. WaterSeer™ will then return the repaired or replaced Product or component to the claimant. WaterSeer™ will ground/economy ship all replacement warranty Products or components to claimant. Charges will apply for any alternative shipping methods requested by claimant. Product shipped outside of its initial purchase country may be subject to additional shipping costs.

This Limited Warranty will be void if the claim has resulted from: (a) improper assembly of the Product, (b) usage of the Product beyond its design, (c) overfilling of the Product’s water tank, as explained in the WaterSeer™ Assembly Manual, (d) use of a purification product in the water tank other than that which has been approved by WaterSeer™ , (e) use of improper cleaning materials, as described in the preventative maintenance steps in the WaterSeer™ Owner’s Manual, (f) use and/or storage of Product in inclement weather, including but not limited, to extreme temperatures and moisture; (g) accident, abuse, misuse, misapplication or as a result of any modification other than that authorized by WaterSeer™ , and (h) improper preventative maintenance steps as described in the WaterSeer™ Owner’s Manual.

The Warranty does not apply to any of the following situations:

  • Products that have not been installed, used, or operated in accordance with WaterSeer™’s Product specification sheets, installation guides, and technical support communications;
  • Products damaged or modified due to misuse, neglect, tampering, alteration, disassembly, or other causes, either internally or externally;
  • Products damaged or failed to operate as specified due to improper installation, operation, handling, or use, including use under conditions for which the Product was not designed, use in an unsuitable environment, or use in a manner contrary to WaterSeer™’s instructions or applicable laws or regulations;
  • Products damaged or failed to operate as specified due to fire, water, corrosion, biological infestations, or acts of God;
  • Products damaged or failed to operate as specified because of input electrical voltage that creates operating conditions beyond the maximum limit listed in the WaterSeer™ Product specifications, including high input voltage from solar panels, batteries, generators, or lightning strikes;
  • Incidental or consequential damage to Products caused by defects of other components of the solar power system not supplied by WaterSeer™;
  • Products that have been defaced, altered, or had their original identification markings removed including the WaterSeer™ trademark and Product serial number;
  • Products damaged due to shipping, transportation, or handling; and normal wear and tear.

Where the product warranty has been deemed void, the costs of repair and any associated shipping costs shall be borne by the claimant. WaterSeer™ will contact the claimant prior to return of the repaired Product or component.

The term of any implied warranty, including but not limited to any implied warranty of merchantability or fitness for a particular purpose that may arise under your country province or state law is limited to the term of the express Limited Warranty in the first paragraph, above.

WaterSeer™ shall not be liable for any direct, consequential, incidental, indirect, or special damages under this Limited Warranty or any implied warranty that may arise under your country, province, or state law.

For determination of warranty eligibility, please submit (1) a copy of the original invoice and evidence of payment, and (2) an image of the Product label showing the serial number. If you have purchased extended warranty, please submit the evidence of the warranty extension as well.

The original Product label must be completely legible. Otherwise, WaterSeer™ is entitled to refuse to provide warranty services. WaterSeer™ will determine the warranty eligibility and assist you in submitting a Return Merchandise Authorization (RMA).

To the extent permitted by law, this limited warranty and the remedies set forth are exclusive and in lieu of all other warranties, remedies, and conditions, whether express, implied, oral, written, or statutory.

Waterseer disclaims all statutory and implied warranties, including without limitation, warranties of merchantability and fitness for a particular purpose and warranties against hidden or latent defects, to the extent permitted by applicable law. If any implied warranties cannot be disclaimed, WaterSeer™ limits the duration and remedies of such warranties to the duration of this express warranty, to the extent permitted by applicable law.

Except as provided in this limited warranty and to the maximum extent permitted by law, WaterSeer™ is not responsible for direct, special, incident al or consequential damages resulting from any breach of warranty or condition, or under any other legal theory, including but not limited to loss of use; loss of revenue; loss of actual or anticipated profits (including loss of profits on contracts); loss of the use of money; loss of anticipated savings; loss of business; loss of opportunity; loss of goodwill; loss of reputation; or any indirect or consequential loss or damage howsoever caused including the replacement of equipment and property.

No one has the authority to assume any additional liability or responsibility for WaterSeer™ in connection with the Products. This Warranty may not be changed or modified except in writing, signed by an officer of WaterSeer™.

The terms and conditions of this Warranty are to be governed by, and interpreted according to, the internal laws of the State of Delaware, United States of America, without giving effect to or applying its choice of law provisions. The United Nations Convention on the Sale of International Goods shall not apply either to the sale of Products in relation to this Warranty.

A dispute arising from the terms of this Limited Warranty will be resolved by arbitration under the guidelines American Arbitration Association guidelines and will be final.
